Knowledge is the first step in breaking the stigma and safeguarding the welfare of our community. Under the Malaysian Mental Health Act 2001, there are three primary ways a person enters psychiatric care namely
📍 Voluntary (Section 9): The path of autonomy. The person chooses and requests to seek medical help, and generally have the right to leave within 72 hours of asking.
📍 Involuntary (Section 10): The safety net. When someone is a risk to themselves or others, relatives and doctors can intervene using Forms 3 and 4 to ensure they get urgent treatment.
📍 Court-Ordered (Section 52): The protector of interests. This isn’t just about treatment; it’s about whether a person is legally capable of managing their life and finances. As seen in Wong Kim v Loh Kim Foh, the High Court acts as a rigorous gatekeeper to ensure no one is unfairly stripped of their independence.
